It suggests ways of interpreting the national security exception in a way as to narrow its scope in reference to standards posed by the European Court of Human Rights in Europe and the <em>International Convenant on Civil and Political Rights<\/em>. The paper also argues for the creation of new treaties to fill legal gaps in the protection of transfer of data through Cloud computing.<\/p>\n\n\n\n<p><strong>Ioanna Tourkochoriti<\/strong> is a Visiting Professor, and a legal scholar working in the field of human rights, constitutional law, comparative law, international law, antidiscrimination law, philosophy of law, as well as political and moral philosophy. She is currently working on a book project comparing U.S., Canadian and E.U. Employment Discrimination Law.
