On Nov. 12, he was found guilty of four counts of sexual assault and acquitted of one count of sexual assault and one count of forcible confinement.<\/p>\n\n\n\n<p>Nygard faces numerous <a href=\"https:\/\/nationalpost.com\/news\/canada\/nygard-assault\" target=\"_blank\" rel=\"noopener noreferrer\">other sexual assault charges dating back decades in Qu\u00e9bec, Manitoba<\/a> and <a href=\"https:\/\/www.cbc.ca\/news\/canada\/manitoba\/peter-nygard-winnipeg-charges-1.6903579\" target=\"_blank\" rel=\"noopener noreferrer\">the United States<\/a>.<\/p>\n\n\n\n<p>In 1967, Nygard <a href=\"https:\/\/www.forbes.com\/forbes\/2010\/1206\/features-peter-nygard-sexual-harassment-answers-to-no-one.html\" target=\"_blank\" rel=\"noopener noreferrer\">founded a multi-million-dollar fashion house<\/a>, Nyg\u00e5rd International. Before the sexual assault allegations, Nygard was an established figure in celebrity circles.<\/span><br>\n<span class=\"attribution\"><span class=\"source\">(Shutterstock)<\/span><\/span><\/figcaption><\/figure>\n\n\n\n<h2 id=\"prevalence-of-sexual-assault\" class=\"wp-block-heading\">Prevalence of sexual assault<\/h2>\n\n\n\n<p>At the height of the <a href=\"https:\/\/canadianwomen.org\/the-facts\/the-metoo-movement-in-canada\/\" target=\"_blank\" rel=\"noopener noreferrer\">#MeToo movement in 2017<\/a>, several high-profile defendants were charged with sex crimes. In these cases, it was common for defendants to have numerous victims with assaults taking place over decades-long timespans.<\/p>\n\n\n\n<p>Former film producer Harvey Weinstein had more than 80 women accuse him of <a href=\"https:\/\/www.usatoday.com\/story\/life\/people\/2017\/10\/27\/weinstein-scandal-complete-list-accusers\/804663001\/\" target=\"_blank\" rel=\"noopener noreferrer\">sexual harassment or assault as far back as the 1970s<\/a>. He has been found <a href=\"https:\/\/variety.com\/2023\/film\/news\/harvey-weinstein-sentenced-los-angeles-prison-term-1235531069\/\" target=\"_blank\" rel=\"noopener noreferrer\">guilty of numerous charges<\/a>.<\/p>\n\n\n\n<p>Former Canadian radio host Jian Ghomeshi was accused by eight women of sexual abuse, with alleged incidents occurring in 2002 and 2003 \u2014 <a href=\"https:\/\/www.theglobeandmail.com\/news\/national\/jian-ghomeshi-charged-with-sexual-assault\/article21788631\/\" target=\"_blank\" rel=\"noopener noreferrer\">five charges were laid in 2014<\/a>. Ghomeshi was <a href=\"https:\/\/www.cbc.ca\/news\/canada\/toronto\/jian-ghomeshi-sexual-assault-trial-ruling-1.3505446\" target=\"_blank\" rel=\"noopener noreferrer\">acquitted of all charges<\/a> in 2016.<\/p>\n\n\n\n<p>According to Statistics Canada, police-reported cases of sexual assault were <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/daily-quotidien\/220802\/dq220802a-eng.htm?HPA=1\" target=\"_blank\" rel=\"noopener noreferrer\">at their highest in 2021<\/a>.<\/p>\n\n\n\n<h2 id=\"factors-impacting-verdict-and-perceptions\" class=\"wp-block-heading\">Factors impacting verdict and perceptions<\/h2>\n\n\n\n<p>A delay in reporting sexual assault can <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/pub\/85-002-x\/2017001\/article\/54870-eng.htm\" target=\"_blank\" rel=\"noopener noreferrer\">decrease the likelihood of charges being laid<\/a>. Although this decrease is not necessarily specific to sexual assault, physical evidence like blood and semen is lost if not collected soon after the crime, potentially making a conviction more difficult.<\/p>\n\n\n\n<p>In sexual assault cases, it may become a matter of victim versus defendant credibility. Although a defendant&#8217;s race can impact case outcomes, <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/pub\/85-002-x\/2023001\/article\/00004-eng.htm\" target=\"_blank\" rel=\"noopener noreferrer\">with higher rates of minorities being incarcerated<\/a>, the interaction of defendant race and status in these types of cases is less clear.<\/p>\n\n\n\n<p>Our research investigated how <a href=\"https:\/\/doi.org\/10.1177\/08862605231153873\" target=\"_blank\" rel=\"noopener noreferrer\">juror decision-making could be affected<\/a> by defendants&#8217; occupational status and race, along with the number of alleged victims and the delay in reporting a sexual assault. We presented 752 mock jurors with a fictional trial transcript, and asked them to provide a verdict, a rating of guilt, as well as ratings regarding their perceptions of the victim and defendant.<\/p>\n\n\n\n<p>Results indicated that mock jurors were more likely to reach a guilty verdict, and perceive the defendant less favourable and the victim more favourable when the defendant was white (as opposed to Black), and when there were multiple allegations against the defendant.<\/p>\n\n\n\n<p>A delay in reporting sexual assault was not influential for mock jurors&#8217; ratings, nor was occupational status. It is possible for high-profile defendants to be held accountable numerous years after committing their crimes. Multiple allegations may provide credibility to the accusations.<\/p>\n\n\n\n<h2 id=\"nygard-accumulated-charges\" class=\"wp-block-heading\">Nygard: Accumulated charges<\/h2>\n\n\n\n<p>Several alleged victims of assaults by Nygard are awaiting their day in court. Additional allegations of sex crimes perpetrated by Nygard will continue to be tested in court, with an upcoming court date <a href=\"https:\/\/www.cbc.ca\/news\/canada\/montreal\/nygard-sex-assault-trial-1.6810947\" target=\"_blank\" rel=\"noopener noreferrer\">in Qu\u00e9bec in the new year<\/a>.<\/p>\n\n\n\n<p>Neither Nygard&#8217;s high-profile status nor the delay in reporting from his victims protected him.
