Updates to the Building Ontario Businesses Initiative Act (BOBIA)<\/a>, O.Reg. 422\/23, will impact procurement requirements for purchases\u00a0under<\/strong>\u00a0the\u00a0Open Competitive procurement threshold<\/a> starting April 1, 2024.\u00a0BOBIA\u00a0does not\u00a0<\/strong>override the university\u2019s requirement to engage in\u00a0Competitive Procurement<\/a>\u00a0(ex: receiving competing quotations or engaging in\u00a0Open Competitive procurement<\/a>\u00a0where required by the\u00a0Procurement Policy<\/a>).<\/p>\n

When completing a Cheque Requisition or Purchase Requisition in eShop, you will be asked to demonstrate your compliance<\/a> with BOBIA by answering two mandatory<\/strong> questions.<\/p>\n

Step 1: Navigate to the Correct Means of Procurement<\/h2>\n

The means of procurement<\/a> available to you is based on the Total Procurement Value<\/a> of your purchase. This page focuses on eShop requisition forms only – if your means of procurement is eCard, Corporate Card (PCard)<\/a>, Travel and Expense System<\/a>, or eShop Catalogues (Convenience Vendors<\/a>), please see “How to Demonstrate Compliance<\/a>” for more information.<\/p>\n

Step 2: Locate the BOBIA Questions<\/h2>\n

Cheque Requisition Form<\/h3>\n

Within the Cheque Requisition form, find the “Building Ontario Businesses Initiative Act (BOBIA)” header above the Vendor Information section.<\/p>\n

Important<\/strong>: With some exceptions, a Cheque Requisition form can be used to request payment to a Vendor for\u00a0Non-competitive procurements<\/a> only. Please do not use this form if a Purchase Requisition form<\/a> has already been processed, or the payment is for personal reimbursement of business expenses<\/a>.<\/p>\n

Purchase Requisition Form<\/h3>\n

Within the Purchase Requisition form, find the “Building Ontario Businesses Initiative Act (BOBIA)” header under the Competitive Bid Requirements section.<\/p>\n

Step 3: Answer the BOBIA Questions<\/h2>\n

You will be required to answer\u00a0both<\/strong> BOBIA questions with respect to the Vendor you are procuring goods or services from.<\/p>\n

Question 1: Is this an Ontario Business<\/a>?<\/h3>\n

The university may rely on a\u00a0representation by the Vendor<\/a> regarding their status as an Ontario Business as defined by BOBIA. Even where the status of the Vendor may appear obvious, Procurement Services encourages you to seek the appropriate representation.<\/p>\n

Procurement was completed<\/strong> before April 1, 2024.<\/td>\nYou are using a currently valid eShop Contract Reference Number as your Competitive Bid Requirement. HINT:<\/strong>\u00a0did you know that eShop has a \u201cContracts\u201d module you can search using the Contract Reference Number provided to you upon Contract execution? Look for the\u00a0\"Icon\u00a0icon in the eShop menu bar.<\/p>\n

Remember, if your Vendor doesn\u2019t have the trillium symbol that may mean they haven\u2019t had the opportunity to represent their status yet and does not necessarily confirm they are not<\/strong>\u00a0an Ontario Business.<\/p>\n

Question 2: How did you consider Ontario Businesses in making your purchase decision?<\/h3>\n

BOBIA requires you to give preference to Ontario Businesses when seeking quotes as part of the Non-competitive and Invitational Competitive Procurement<\/a> requirements.<\/p>\n
