Most depictions of international climate law focus on multilateral fora for example, those commitments made under the UN Framework Convention on Climate Change such as the Paris Agreement. However, a new and equally important field of law has emerged on the topic of climate risk that is, the financial risks incurred by companies from events caused by climate change. The exciting thing about this rapidly evolving body of law is that it enables private actors to bring cases before domestic courts around the world. These cases have the potential to have a profound impact on the companies and actors at the very source of the climate problem. Emerging trends of private action in climate law leads us to consider the dynamic and significant opportunities for furthered climate action.
