Equipment Rental – End User License Agreement (EULA)

Any violation of this agreement may result in the immediate recall of all loaned equipment and a refusal of future loans.
The borrower agrees they will:
- Know and abide by the Student Rights and Responsibilities Policy, the Acceptable Use Policy for Information Technology and any relevant collective bargaining agreements.
- Check their Carleton email daily (including junk/spam) for messages from the School of IT and its representatives.
- Return all equipment in the condition it was loaned to them.
- Return the equipment in person to the School of IT Staff.
- Return the equipment by the due date and time (or immediately if it is recalled).
- Report any loss or damage immediately to the School of IT.
- Be solely responsible for reimbursing the School of IT for the cost to fix or replace equipment in the event of loss, theft, accidental damage, or destruction.
Additional Terms:
- The borrower is responsible to know and abide by the Students Rights and Responsibilities Policy (SRR), the Acceptable Use Policy for Information Technology (AUPIT), and any applicable collective bargaining agreements.
- The borrower understands that, should their conduct warrant it, a charge of non-academic misconduct could be filed with the Office of Student Affairs. Should an investigation be required, a report may be submitted to Campus Safety Services or the Ottawa Police Service as appropriate. Students may contact the Ombudsperson at Carleton during this process. As per the SRR, a. “No student shall misappropriate, destroy or otherwise damage University property” (6.3). b. “No Student shall abuse any University computer […], to access, alter or remove computer files or software without proper authorization, purposefully misplace, or deprive others of access to such computer resources” (6.4) c. No student shall possess University property or the property of any member of the University community without the permission of the rightful owner. (6.15)
- Violations as outlined in the SRR are considered Non-academic misconduct and therefore subject to the procedures and sanctions outlined in the SRR (8.A) such as: a. Restriction from specific University facilities and/or computing services of the facility/department or unit related to the incident. b. Restitution for all damages. (The student will be provided with a clear outline of costs in arriving at this sum on request.)
- Equipment loans from the School of IT may be restricted by course, role, or project based on the availability of the equipment.
- The loaned equipment shall remain in the possession of the borrower until it is returned.
- The loaned item must be returned in person by the borrower to a staff member of the School of IT.
- The condition of the returned equipment will be evaluated by a Staff member of the School of IT before returning the equipment to circulation (within one business day). Any damage or alteration will be documented and reported to the Director of the School of IT.
- In the event of loss, theft, damage and/or destruction of the loaned equipment, the borrower will be solely responsible for replacing the equipment or reimbursing the School of IT for the cost to fix or replace it. When equipment cannot be replaced (e.g. no longer manufactured or sold) the Director of the School of IT will recommend equipment of equal or lesser value that will restore the level of service the original equipment provided.
- For individual items or kits valued under $2,500 the student is responsible for the replacement cost. For individual items or kits valued over $2,500 CAD, the student will be responsible for up to $2,500 (the insurance deductible). The borrower may still be liable for costs not covered by the insurance policy such as additional damage to university property.
- The borrower must immediately contact a Staff member for the School of IT if any harm comes to the loaned equipment.
- The loaned equipment is only to be used for educational, non-commercial purposes.
- As per AUPIT, the borrower is responsible for “adhering to software license agreements as applicable”.
