Picture This Co-op Photo Contest

I, the person submitting this form, own and control the photographs, copies attached to this Waiver and submission form (the “Photograph”), and their copyright, and agree that Carleton University, the publisher of a project with the working title “Picture This Co-op Photo Contest” (the “Project”), is permitted to copy, use, reproduce, publish, exploit, and incorporate the Photograph in and in connection with the publication, distribution, exploitation and advertising of the Project at Carleton University’s sole and absolute discretion.

I acknowledge and agree to the following regarding the grant of rights outlined above:

The rights granted are without any monetary fees or other financial consideration, or restrictions related to the market, term, platform, media, format and device, including for all forms of printed and digital distribution throughout the universe in perpetuity;
Carleton University is not obligated to use the Photograph in the Project;
Carleton University may use, publish and advertise my name, program, year, and employer in connection with the Photograph, at Carleton University’s sole and absolute discretion;
All of the rights granted are irrevocably granted to Carleton University, its successors, licensees and assignee;
Carleton University may, without further consent of myself, assign or license the rights granted to any other party;
Carleton University may edit the Photograph in its sole and absolute discretion;
Carleton University’s use of the Photograph will not subject Carleton University to liability for any fees to any party, nor will it infringe upon or violate any rights of any party; and
If it is alleged that Carleton University or any of its successors, licensees and assignees have breached their rights, my only remedy will be an action at law for financial damages, and neither myself nor any party claiming through or in place of myself has the right to interfere with the exercise of the rights granted.

My consideration for this waiver is the opportunity to have the Photograph being included in the Project.

I waive, as against Carleton University and its representatives, successors, assigns, and licensees, all of my so-called “moral rights” or rights of “droit moral” which I may have or will acquire in respect of the Photograph.

I have the full authority to grant these rights, and no further consent is required to enable Carleton University’s use of the Photograph for the uses outlined herein.

I obtained permission from the people in the Photograph and indemnify Carleton University with respect to any claims from such people.

This release constitutes the entire agreement with respect to the matters set out herein and shall be governed by the laws of the Province of Ontario and the federal laws applicable therein. I have had the opportunity to read and fully understand the terms of this release. This release shall be binding on my heirs, executors, administrators and assigns.

Pursuant to Ontario’s Freedom of Information and Protection of Privacy Act, I consent to the collection of my personal information by Carleton University, its employees, agents and representatives to be used for the purposes and disclosed to third parties as described above.

Any personal information collected through this contest will be used and disclosed by Carleton University under the authority of the Carleton University Act, and in accordance with sections 39, 41 and 42 of Ontario’s Freedom of Information and Protection of Privacy Act and applicable Carleton University privacy policies, which can be read here: http://carleton.ca/privacy/privacy-policies/

By entering this contest, all individuals consent to the collection and use of the personal information provided and contained in any submitted entry. Entrants may have their names, program, year, employer, photographs, photo titles, and descriptions (if provided) published on social media, websites, or reports to promote Co-operative Education. Participants provide their express consent to Co-operative Education and Carleton University to post thee photo on these websites, use the photo for future promotional or educational use through social media, print media, other forms of marketing, and/or online resources.

The information provided will not be used for any purposes other than those stated upon this form unless the entrant directs otherwise. Carleton University is fully compliant with FIPPA and endeavors at all times to treat all personal information in accordance with this law.
